Handling Personal Injury Lawsuits

Auto Accidents:

Life does not always work out according to your original plan. When an auto accident occurs because of the negligence of another person or company, you owe it to yourself to get the best personal injury lawyer possible. Damages can include medical bills, vehicle repair, lost wages, and any other injuries sustained during the accident. Courts also award punitive damages based on extreme negligence involving irresponsible behavior or defective parts of the vehicle.

Automobile accidents give rise to the majority of personal injury claims in the U.S. Car collisions often carry legal consequences in proportion to the severity of the accident. Legal claims which arise from motor vehicle accidents are governed by the law of negligence. A person who operates a vehicle is expected to exercise reasonable care. Failure to use reasonable care is considered negligent. The injured party is required to prove that the person who caused the accident was negligent, that negligence was a proximate cause of the accident, and that the accident caused the plaintiff's injuries. Let us walk you through your situation and provide you with answers on how to recover the damages you deserve.

Construction Accidents:

Construction accidents spring from a myriad of circumstances ranging from falls from or through roofs of buildings, being run over and crushed by construction equipment, falls from structures other than roofs, such as scaffoldings, ladders or windows even when workers are wearing safety harnesses and lanyards, collisions with motor vehicles, mechanical defects in lifting and operational equipment, fires and explosions involving severe burns, trench collapses that bury workers in soil, electrocution, exposure to hazardous chemicals, etc. Accidents may result from inadequate safety inspections, someone else's negligence, poor equipment or OSHA violations. If a construction worker is injured, in many cases a claim can be brought against the owner or contractor as well as a workers' compensation claim. Workers' compensation benefits may not be enough to cover the expenses that can result from the serious injuries that construction accidents can cause; it is important to hold all the negligent parties responsible.

The employer’s liability is absolute and the employee’s fault, if any, is normally not even considered when establishing responsibility for an accident unless he had refused to follow explicit directions, or had refused to use an appropriate safety device. The employer is absolutely liable even if the employee refused to use safety equipment, ignored company safety policies, or was impaired by drugs or alcohol during the time of the accident. New York State is the only state that imposes such a liability standard. In the latter case, the third party must prove beyond a reasonable doubt that the employee absolutely refused the use of a safety device offered despite the dangers involved. Damages may include money for pain and suffering, healthcare expenses, wage loss and loss of pension or other fringe benefits.

Medical Malpractice:

Medical malpractice occurs due to the negligence of a medical professional or medical facility. When a medical professional or facility cares for you, they have a duty to provide the best possible care. When they violate that duty, a medical malpractice attorney can aggressively seek compensation for your injury. Medical malpractice does not occur every time medical treatment is not successful. The duty is to provide good medical care according to accepted community standards, or, in the case of a specialist, accepted standards in that medical specialty.

Patients have the right to expect accurate diagnosis and appropriate treatment from the medical service providers. When qualified medical practitioners and registered service providers fail to honor this reasonable expectation, injured parties look for legal recourse and damages. A delay in diagnosis or an inappropriate treatment may cause devastating consequences affecting the quality of life of the patient.

Nursing Home Abuse:

Physical or mental abuse and neglect of our elderly is a crime that many times goes by unnoticed. Many of these victims are unlikely to report nursing home abuse fearing it will result in further neglect. While this abuse isn’t always reported, it is a recurrent problem with often deadly results. When the trained professionals that you trust with your elder parents inflict this abuse, you have the right to demand answers. Those who violate their duty to take professional care of our elderly should be punished severely. You can hold these abusive nursing homes accountable through lawsuits. Across the country, families of those abused are receiving compensation for the pain and suffering of the residents of the inadequate nursing homes. While we hope that you never need us, The Law Offices of Jeffrey J. Shapiro offers a free consultation for those who been effected by nursing home negligence. Our firm has handled nursing home negligence cases for clients whose trust was breached and loved ones harmed by nursing home neglect.
